(1) The Lieutenant-Governor in Council, in his discretion, may order that section 2 does not apply, or does not apply subject to such terms and conditions as the Liet:tenant-Governor in Council may specify, to residential premises situated within such part of the Province as the Lieutenant-Governor in Council may specify. (2) Upon application by the council of a municipality other than a regional district, and upon being satisfied that it is unreasonable to require that section 2 be applicable to residential premises situated within the municipality, the Lieutenant-Governor in Council may order that section 2 does not apply, or does not apply subject to such terms and conditions as the Lievtenant-Governor in Council may specify, to residential premises situated within that municipality. (3) Upon application by the council of a regional district, and upon being satisfied that it is unreasonable to: require that section 2 be applicable to residential premises situated within that part of the regional district not within a municipality, the Lieutenant-Governor in Council may order that section 2 does not apply, or does not apply subject to such terms and conditions as the Lieutenant-Governor in Council may specify, to residential premises situated within that part of the regional district not within a municipality. 4. Where a tenant, during the period from the first day of January, 1974 to the date this Act receives Royal Assent, has paid to a landlord an amount of rent for residential premises that exceeds the amount of rent permitted to be paid under section 2, the landlord to whom the rent was paid shall, forthwith after the date this Act receives Royal Assent, pay the amount of the excess to the tenant. 5. This Act shall be deemed to have come into force on the first day of January, 1974, and is retroactive to the extent necessary to give full force and effect to its provisions on, from and after that date.
