"works" means the Water Main System and the Sewer Main System.

The City shall

(a) arrange for and oversee the construction of the Works and take

al | responsibility for the completion and maintenance thereof; and

(&) commence construction forthwith, with an estimated completion

data of December 31, 1985,

The City shall not approve engagement of the Contractor for
construction of the Works without the consent of the Developer, such

consent not to be unreasonably withheld.

The City shall. provide the Developer with a letter of. undertaking

satisfactory to the Developer from the Engineer stat ing that:

(a) the Engineer has been retained to provide on- site inspection
- through @ person qualified and experienced in the Inspection of
mun ici pal works under the Eng Ineer's direction;

(b) the ‘name of the person or. persons who will be involved in the
inspection; and |

(c) that the Engineer is fami Lar with the’ design and speci ficat! fons

and accepts: the responsibility of determining if the Contractor
ts. carrying» out. the Wor ks in “accordance with this Agreement, of
certifying progress. payments, and of preparing accurate as- bul lt.

drawings upon complett ion of the Works.
