Eng., Deputy City Engineer FILE: No. S# 5/91 RIGHT OF WAY AGREEMENT - HIDDEN HILLS SUBDIVISION That Council authorize the Mayor and City Clerk to execute the revised sanitary sewer Right of Way agreements for the Hidden Hills subdivision. The Hidden Hills subdivision involved the redevelopment of four lots: bounded by Westwood Street, Davies Avenue and Fox Street. The City required a sanitary sewer Pight of Way adjoining portions of the northern lot lines. The Right of Way was originally established and granted at time of subdivision registration in April 1991. During the construction process the footing of the building was accidentally constructed 300 mm within the Right of Way. To simplify matters for the future we have agreed to narrow the Right of Way so that no portions of the building or its footings and foundations are within the Right of Way for the sanitary sewer. The Engineering Department is satisfied that there is no detrimental affect to future maintenance by decreasing the Right of Way and we therefore recommend that Council approve the revised Right of Way agreement. | The attached sketch shows the new Right of Way in solid black line and the old Right of Way in dotted line format. | C.F.
