The Dollar amounts hereinbefore set out are based upon the Municipality's Preliminary Engineering Desien and Preliminary Cost Estimates. As a result of Final Engineering Design to be carried out by the Developer, quantities, loca- tions, sizes, etc. might vary from that determined from the preliminary work and the Municivality does not in any way ensure that actual increased costs resulting from Engineering Design and Tender Call will not occur. Any in- creased costs over and above the stated bonding amounts shall be the responsibility of the Developer. Security: 13. As security for the due and prover performance of all of the covenants and agreements in this Contract contained, in relation to those works and services required for -Phase I hareof, and es set out in Development Agreement No. 1, the Developer covenants and agrees to deposit with the Municipality, by Le of Credit the sum of Six Hundred Thirty-Three Thousand Nine dred and Eighty Dollars ($633,980.00) prior to registration this Land Use Contract in the Land Registry Office.
