All other words end expressions in this Agreement, unless the context otherwise requires, shall have the meaning assigned to them by the “City of Port Coquitlam Zoning By-law, 1969, No. 918", as amended or, if not definea therein, by the "Muncfpal Act" or the “"Interpreration Act" of the Province of British Columbia. 2. The Developer is the registered ower of an estate in fee simple of ALL AND SINGULAR that certain parcel or tract of land and Premises situate, lying and being in the City of Port Coquitlam, in the Province of British Columbia, and being more particularly ‘known and described as: 2. Lot 1, Block C, Plan 2106; ii. Lots 8-16, inclusive, slock C, Plan 2106; Lots 2 & 3, Block C, Plan 4842; Lets 1-9, inclusive, Block 8, Plan 21375 Lots 26-31, inclusive, Block 8, Plan 2137; sll ‘those Portions of closed lane described in By-law No. 1394 of the City cited as the "Plan 2106 snd Plan 2137 Road Closure By-law, 1975, No. 1394"; all of District Lot 255, Greup 1, New Westminster District, (hereinafter called "the land" 3. The Developer has obtained the consent of all persons holding any registered interest in the land as set out in the Consents to the use and development set forth herein, which Consents are attached hereto, 4. Except as otherwise provided in this Land Use Contract che land, including the surface of water, and any and all buildings, structures, and improvements erected thereon, thereover, or therein shall be used for M-3 (Special Industrial) uses only to the iimit and extent erovided in Part VII of tha “City of Port Coquitlam Zoning By-lm, 3969, No. 918" as in force on the date of xegistration of this Agreement in the Nev Westminster Land Registry Office; PROVIDED that the maximum height of buildings, structures, or other improvements shall be thirty feet (30'). A copy of the said Part Vil is attached hereto as Appendix 1. 5 {a) No building, structure or inprovement shall be sited upcn the land except in compliance with the site plan and particulars set out in Appendices 2 and 6 herein which contain respectively: Appendix 2: Perspective (Sketch 0); _ Appendix 3: Site Lay-out (Sketch 1); Appendix 4: Elevations (Sketch 2); Appendix 5: Elevations and Section (Sketch 3); Appendix 6: Landscape Plan (Li); showing a Warehouse ~ Industrial development prepared by Musson Catrell & Associates, Architects and bearing Job No. 7557. (>) All construction details shall conforu to the provisions of the applicable portions of the National Building Code of Canada, the British Columbia Plumbing Code, and the "City of Port Coquitlan Building and Plumbing Code Adwintstration By-law, 1974, No. 1298", 6. Notwithstanding the provisions of the “City of Port Coquitias Subdivision of Land By-law, 1970, Nc. 992" the land shail be subdivided in the manner shown on the proposed Plan of Subdivision attached hereto as Appendix 7 and then shall not be further subdivided in any manner what- soever. ra No sign or signs shall be erected upon the land or on any building or structure thereon except those shown and set out in the particulars in the Schedules hereto. 8. Off-street parking, lesding spaces, garbage pick-up areas, and other facilities and amenities shall be provided, located and constructed in accordance with the Appendices hereto. 9, All buildings and structures shall be constructed strictly in cozpli- ance with and according to the plans, elevations, and peropectives set got in the Appendices hereto, provided (a) that all building plans shall be subject to the approval of the Council to be expreosed by resolution, and (b) that minor alterations to the plang sv approved by the Council m.y be permitted and approved by the Building Inspector. 10. AL landscaping, surface treatments, fences and screens shall be constructed, located, provided and maintained ta compliance with and accoridng to the plans set out in the Appendices hereto.
