The Grantee requires the registration of this document as a covenant against the lands and the Grantor and Contractor have agreed to enter into this covenant on behalf of themselves and all successors entitled to the la lands. NOW THEREFORE, in consideration of the premises and covenants herein contained and in consideration of the sum of Two ($2.00) Dollars now paid by the Grantee to the Grantor) the receipt whereof is hereby acknowledged) the parties hereto do hereby covenant and agree with each other as follows: l. The dwelling house located on the said lands shall contain a pump to facilitate the removal of sewage from the dwelling into the sewer system, which pump shall be maintained by the Grantor and kept in good running order at all times. 2. The Grantor hereby waives, releases and discharges forever the Grantee from all manner of actions, causes of actions, suits, claims and demands whatsoever which the owner has or may have in respect of any loss or damage resulting from the sewer backing up intro the said lands and the dwelling house located thereon. 3. The Grantor hereby agrees to save harmless and indemnify the Grantee from all claims or rights of action which any other person or corporation has or may have against the Grantee in respect of any loss or damage which may be caused by the sewer backing up into the said lands and the dwelling house located thereon. 4. It is agreed between the parties hereto that in the event a claim is made by anyone against the Grantee which is a claim for which the Grantor may have to indemnify the Grantee under the provisions of paragraph 3 above and so often as the same occurs, the Grantee will notify the Grantor of such claim, afford the Grantor a reasonable opportunity to defend such claim at the Grantor's cost if the Grantor wishes to do so and the Grantee agrees that it will not compromise or settle any such claim without the prior consent of the Grantor. 5. Tt is understood and agreed by the parties hereto that in accepting the foregoing waiver and indemnity the Grantee does not thereby acknowledge that it would otherwise be liable for any claim arising out of the sewec backing up into the said lands and the dwelling house located thereon. 6.
