THE CORPORATION OF THE CITY OF PORT c ULTLAM

BY-LAW NO. 1287

& By-law to authorize the City to enter into Lend Use Contract No. 5.
WHEREAS the "City of Port Coquitlam Zoning By-law, 1969, No. 918" as
amended designates certain areas of land within the zones set out therein as
“Development Areas‘;
AND WHEREAS the lands hereinafter described are eituate within an
area so designated;
AND WHEREAS tha Owner of the said lends has nade applicetion for a
Land Use Contract to authorize works, development, and use sone aspecte of which
ate not in conformity with the relevant City By-laws as the same epply to the
zoné in which the said lands are situate;
AND WHEREAS the Council hag given due regard to the following con-
siderations:
1. (a) The promotion of health, safety, convenience and welfare of the public.
{b) the prevention of the overcrowding of land, and the preservation of
the amenities particular to any zone,
() the securing of adequate light, air and access.
(d) the value of the land and the nature of ite preeent and prospective
use and occupancy,
(e) the character of each zone, the character of the buildings already
erected and the peculier suitability of the zone for particular uses.
(£) the conservation of Property values.
2. (a) the development of areas to Promote greater efficiency and quality,
(b) the impact of development on present and future public costs,
(c) the betterment of the environment.
(d) the fulfillment of community goals,
(e) the provision of necessary public space,
ead it is deemed desirable to enter into Land Use Contrect No, £ in the fora
end to the extent hereinafter provided;
NOW THEREFORE the Municipal Council of The Corporation of the City of

Port Coquitlam, in open meting assembled, enacte as follows: %

1. The Council of The Corporation of the City of Port Coquitlam ia hereby

authorized and empowered to enter into a Land Use Contract with Florence Mylroie,

Frank Yerfo Kimmel end Mary Mildred Kismel, in the form and to the extent in
"Land Use Contract Ho. 5" which is the Schedule hereto annexed and nade part
of this By-law,
2. The said Land Use Contract No. 5 shall extend to and shalZ regulate the
development and use of the lands deseribed as:

"Lot 4, Block 32, District Lot 464, Group 1, Plen 7080, New Westeinster
District,
3. Land Use Contract Ho. 5 shall have the force and effect of a restrictive
Covenant running with the land described in Section 2 hereof aad shall be
registered in the New Westminster Land Registry Office by the City.
4, - This By-law may be cited for all purposes as "Lend Use Contract No. 5,
Authorization By-lew, 1973, No. 1287", :
