Brown Director of Planning SUBJECT: Existing Non-conforming Duplex Rezoning 3424-27 Carlisie RECOMMENDATIONS: A. That City Council reconfirm the policy of rezoning existing non-conforming duplex bulldings to bring them into conformance, : B. That City Council! direct the Clerk's Office to prepare an amendment to the RT-1, Two Family Residential! District, removing the minimum separation requirement between duplex buildings constructed before 1979. BACKGROUND ANDO COMMENTS: Essentially the problem with non-conforming lots is that when the past Zoning Bylaws were changed in 1969 and 1979, no provision was made for uses that became non-conformii.g due to the change. The probiem of existing non-conforming duplexes has been addressed before In an omnibus rezoning bylaw for the area surrounding the Prairie/Coast Meridian commercial district in 1984. A study was carried out and submitted to City Council. Recommendations of the report were to rezone a number of properties. The rezoning bylaw was not submitted to City Council due to objections of several property owners, that they shouid have been granted a higher designation. It is the contention of this report, that replacement of non- conforming uses expected by the past Zoning Bylaw changes have not taken piace. The reason for that is the change would result In a financial loss to the property owners involved. Resolution to the problem, proposed by the omnibus bylaw discussed above was to zone the non-conforming buildings to their correct designation.
