Lot 92, District Lot 289, Group 1, New Westminster District, Plan 19019 (collectively the “Lands") and agrees that the Lands shall not be used or built upon except in accordance with the terms of this Covenant. The Lands shall not be built upon except in accordance wiht the plans prepared by Ron Hoffart, rchitect, attached as Schedules "A-i" and "A-2". The Lands shall be used only for residential purposes by persons aged 55 years or over, their guests and building management staff. Nothing in this Covenant shall affect the City’s rights and powers ir the exercise of its functions under statute, bylaw, resolution, order or regulation, all of which may be fully exercised in relation to the Lands as if this Covenant had not Seen granted. The Covenantor shall release, indemnify and save the City harmless from and against all actions, causes of action, loss, damage, costs, claims and demands of every kind whatsoever, by any person, arising out of or in any way connected with the granting or existence of this Covenant. This Covensut runs with the Lands and is binding upon the Covenantor, its heirs, successors, administrators and assigns. Waiver of any default by the City shall not be deemed to be waiver of any subsequent default; Schedules "A~1" and "A-2" form part of this Covenant; wherever the singular or masculine is used in this Covenant, the same is deemed to include the plural or the feminine or the body politic or corporate as the context permits; every ceference to the Covenantor and the City is deemed to include their heirs, executors, administrators, successors, assigns, employees, agents, officers and invitees; and this Covenant shall enure to the benefit of the City and be binding upon the Covenantor notwithstanding any rule of law or equity to the contrary.
