Port Coquitlam, in the Province of British Columbia, and more particularly known and described as: Lot 1, Section 6, Block 6 North Range 1 East, Plan 69316 New Westminster District (hereinafter called the “Lands") for the purposes of a church building; AND WHEREAS the Developer has agreed to install and maintain certain of the works to serve the proposed development; AND WHEREAS Section 215 of the Land Title Act provides, inter alia, that a covenant, whether of a negative or positive nature, in respect of the use of the land or the use of a building on or to be erected on land, in favour of a Municipality or Crown, may be registered as a charge against the title to that land. NOW THEREFORE THIS AGREEMENT WITNESSETH that pursuant to Section 215 of the Land Title Act, and in consideration of the premises and the mutual covenants and agreements contained herein and the sum of One Dollar ($1.00) now paid to the Developer by the Municipality (the receipt and sufficiency whereof is hereby acknowledged), the parties hereto covenant and agree each with the other as follows: . . 1. THE DEVELOPER COVENANTS AND AGREES with the Municipality: x {a) to construct a detention pond and storm sewer pursuant to the specifications of drawing number 84.57.11 of Lee Melnechenko & Associates Ltd. attached hereto as a schedule to this agreement, > Dr quis will be oucispe (b) that the construction of the said works shall be psy completed by the 3lst day of December, 1987, (c) to maintain the said works in good repair and in substantial sompliance with the said specifications. IT IS MUTUALLY UNDERSTOOD, agreed and declared by and between the parties hereto that: (a) nothing contained or implied herein shall prejudice er affect the rights and powers of the Municipality in the exercise of its functions under any public and private statutes, by-laws, orders and regulations, all of which may be fully and effectively exercised in relation to the lands as if this Agreement had not been executed and delivered by the Developer; 57
