John Weston, lawyer for the Kincolith plaintiffs and a member of CanFREE, said the appeal court de- nied their request on the basis that you can’t get an injunction to prevent the government--from- passing legislation. But he contends it is possible to get a court order blocking implemen- tation of iegislation once it is passed. That’s why the Nisga'a treaty is now entering a critical period. means the government has now enacted the treaty le- gislation. That means a new win- dow of time is open for court challenges, one that may close again on the ef- fective date of the treaty. That's: expected to be sometime in early to mid May. ° If the effective date passes - before the next in-- junction request can be heard, Weston said, the challenge may be too late. Weston said the Kinco- ‘lith chaHenge may well - end up being joined by the courts with another pend- ing challenge of the treaty. That action, launched May 15, making the case that the treaty is unconsti- tutional. “Arguably the court may want to hear this case along with it,” Weston said. He said a non-profit company has been created whereby other Nisga’a people opposed to the trealy can register and join ‘the three main plaintiffs in - the case.
