All servicing costs for water, sewer, drainage, electricity, gas, telephone, road, curb, sidewalk and other construction will be borne by the purchaser. A certified cheque in the amount of 1% of the amount offered must accompany each tender as a deposit and each tender will be open for acceptance by the Counci| for a period of 30 days. Upon a tender being accepted by the Council a further 32% of the offered price must be paid by the successtui tenderer within 10 days or the deposit will be forfeited. The valance of the purchase price will be secured by way of an agreement for sale specifying the development proposed and calling for full payment within 6 months from the date of acceptance of the proposal by the Counci! with interest at the rate of 10% per annum calculated from the date of such acceptance to the date of payment. Offers made subject to rezoning to a zone appropriate for the development proposed may be accepted by the Council subject to the granting of such rezoning and the process of the required zoning amendment bylaw will be initiated by the Council. However, the Council does not obligate itself to pass such zoning bylaw and in recognition of this fact the payment of the further 32% of the offered price required in Section 5 above will be deferred and the said 32% of the offered price must be paid by the successful tenderer within 10 days of the reconsideration, final passage and adoption of the requred zoning amendment bylaw. Additionally, the 6 month period for full payment proposed in Section 5 will extend from the date on which the required zoning amendment bylaw is reconsidered, finally passed and adopted. Should the zoning bylaw not be adopted the developer's proposal will be considered rejected and the certified cheque will be returned. Prospective tenderers are advised that a period of 3 months or longer may be required for pracess of the zoning amendment bylaw. The certified cheques of the unsuccessful tenderers wil! be returned no later than 45 days after the closing time specified above.
