BYLAW NO. 1997

A Bylaw to impose terms and conditions on
encroachments in, or under highways.

WHEREAS, the Municipal Act R.S.B.C. 1979, c. 290 provides that Counci! may by
bylaw regulate uses of or involving a highway or portion of it or public place,
and, except under the terms and conditions imposed by Counci!, a person shall not
excavate in, cause a nuisance on, encumber, obstruct, injure, foul or damage any

portion of a highway or other public place;

NOW THEREFORE the Council of The Corporation of the City of Port Coquitlam in
open meeting assembled enacts as follows:

‘No person shail cause or permit al! or part of a fixture attached to fands or
improvements to tands that the person owns to project,.on over or under.all. or
part of a highway other than a highway designated as "arterial" under Section
31(1) of the Highway Act R.S.B.C. 1979 c. 167 unless the person first enters into
an agreement with the City in-the form of that attached as Schedule A.

This Bylaw.may be.cited for all purposes .as the "Highway Encroachment Bylaw,

1983, No. 1997",
