Kirk February 20, 1992 City Administrator File: Deuglas Island Carlos Felip Director of Planning Douglas Island Rezoning to RS~-3 Planning and Development Committee ~ February 19, 1992 RECOMMENDATION s THAT Council proceed to give third reading to the authorizing bylaw to rezone Douglas Island to RS-3, BACKGROUND: On Monday, February 17, 1992 the Municipal Council, after a Public Hearing on the bylaw tc rezone Douglas Island to RS—-3, referred the issue to Planning and Development Committee to consider the following issues: ae Section 981 of the Municipal Act: Speakers at the Public Hearing suggested that Section 981 of the Municipal Act be used to "freeze" development of the island until further studies are undertaken. Rezoning to Agricultural Use: Speakers at the Hearing questioned the rezoning of the island to RS-3 and suggested that an Agricultural zone could be considered instead. DISCUSSION: 1. Section 981: Section 981 of the Municipal Act does not apply to a Council initiated rezoning situation. Section 981 permits Council to put on hold a (building) development application, for a period of up to 30 days, if there is a conflict between the proposed development and a bylaw affecting land use currently under preparation. These 30 days may be extended for a further 60 days, providing that if the Bylaw in question is not adopted within this period, the owners of the lands for which a Building Permit was withheld are entitled to compensation for damages. oo d/
