EDMONTON (CP) — Top
RCMP officers were
criticized by Mr. Justice
James Laycraft in his report
released today on his inquiry
into Royal American Shows.

Also criticized by the
Alberta Supreme Court
judge was Ron Sheppard, a
former RCMP staff
sergeant, now working as
gaming control officer for
Alberta Attorney-General
Jim Foster.

The report said that from
February, 1977, until the
inguiry started hearings last
June, ‘there was virtually a
total breakdown of com-
munication between the
command of the RCMP and
the cabinet minister
responsibie for law en-
forcement in this province.”

The breakdown was at-
tibuted by the judge to a
series of coincidences and
human failures.

Amajor incident cited was
the belief of Edmonton city
policemen that they were
bugged by RCMP at &_

This was fuelled by what
Layeraft describes as the
failure by the command of
RCMP: D Division in
Manitoba ‘‘to move promp-
tly and efficiently to meet

_the somewhat remarkable

suspicions of the Edmonton
city police.”- ‘

Terming the complaint
‘thizarre—perhaps un-
justified,” the judge sald,
however, that it was con-
veyed to the RCMP directly
by senior officers of the
attorney-general’s depart-
ment. It took 13 days for an
RCMP report to reach
Foster.

“This report, inaccurate
and superficial, was un-
worthy of the RCMP.”
CRITICIZES NADON

Layeralt criticized former
RCMP commissioner
Maurice Nadon for not ac-
ting swiftly to set up an in- —

vestigation of the al-
legations.

When Foster and his
deputy travelled to Ottawa to
discuss the RCMP report
with thencommissioner
Nadon, “many of the errors
were repeated by him.”

“Though he said he would
cause an immediate in-
vestigation to be made,
nearly three weeks elapsed
before Nadon appainted an
officer to conduct the in-
vestigation; then that in-
vestigation gave the im-
pression that its result was

prejudged."’
A further factor in the
breakdown of com-

munication, Laycraft said,
was “the direct refusal of
Nadon’”’ to preduce to the
Alberta attorney-general a
copy of the until-then secret
1972 agreement between the
national revenue depart-
ment and the RCMP to use
confidential tax records to
combat organized crime.

During February and
March, 1977, increasingly
formal and acrimonious
demands were made to the
RCMP for the production of
files and documents relating
to the midway investigation.

“Such a demand for
production of police files by
the prosecution must be sp
rare as to be virtually un-
precedented."

The most serious aspect of
the breakdown in commu-
nication, however, “was the
failure of D Division to in-
vestigate thoroughly and ef-

ficiently” the Winlpeg hotel —

incident.

The judge found no
evidence that the Edmonton
police were under sur-
veillance by RCMP security
officera while in Winnipeg.

Evidence showed there could —

be explanations for the
presence of certain RCMP
officers in the same hotel.
