The second recommendation is to prepare the plan. The
provincial government has axtended a grant to the City in the
sum of $18,000.00 to help prepare this report.

The third recommendation is that a drainage plan be conducted
and a financing scheme be prepared to implement the plan. This
third recommendation, may wel! be the most important of the
three recommendations in. that it will protect the City from
future liability and provincial Ministry of Environment
requirements to provide drainage at the expense of the general
taxpayers.

I would draw Council's attention to Section 954 of the Municipal Act:

Development approval procedures

954. (1) Where a local government has adopted an official community plan, a
zoning bylaw or a rural land use bylaw, it shall by bylaw define procedures under which
an owner of land may apply for amendment to a plan or bylaw, or the issue of a permit
under this Part.

(2) Every application for

(a) an amendment to a plan or bylaw, or
(b) the issue of a permit that requires a resolution of council or a board
under this Part shall be considered by the local

If this policy is adopted it would have limited legal effect if an
applicant for an amendment wishes to proceed,
