6. This Agreement shall not in any way restrict the right
of the City at any and all times to enter into and upon the
Encroachment for the purpose of constructing, maintaining,
inspecting or removing any public works or utility.

7. This Agreement shall not in any way restrict the right
of the City at any time to widen, raise or lower the road way or
boulevard within the Encroachment abutting or adjoining the Lands
AND in the event that the City does alter the width or elevation
or both of the said road way or boulevard, the Owner hereby
releases and forever discharges the City from all manner of
claims of any nature whatsoever which may arise by reason of such
alteration in width or elevation or both.

8. Whenever the singular or masculine is used in this
Agreement, the same shall be deemed to include the plural, the
feminine or the body politic or corporate as the context so
requires; this Agreement runs with the Lands; every reference to
each party hereto shall be deemed to include the heirs, execu-
tors, administrators, successors, permitted assigns, employees,
