The Owner acknowledges that:

(a) payment of the Contributions is entirely voluntary and was made following
receipt of advice from the Owner’s solicitor; and

(b) payment of the Contributions does not obligate the approving officer of the
City to approve any proposed subdivision.

Payment of the Contributions shall exempt the Owner and the Owner’s successor in
the title to the Lands from payment of the related development cost charges for the
capital projects included in the calculations for the proposed development cost
charge bylaws, upon release of the Contributions for the use of the City.
