Backaround and Comments: Under separate cover, Council members have received the following documents: 1, Memo from the City Engineer dated March 4, 1988 on Bil! C-105 (Railway Safety Act) with attachment. Brief prepared by the City of New Westminster for submission to the Parliamentary Standing Committee on Transport respecting Bil} C-105 dated March 15, 1988. n reviewing tnese documents and other information disseminated during the recent LMMO meeting, it became evident that the passage of Bill C-195 will have potential negative implications for municipalities. The City of New Westminster with the assistance of legal and technical consultants have thoroughly reviewed this Bill and have summarized the major potential difficulties for municipalities as follows: 1, Relocation of railways will not be possibile unless the railway company agrees to the proposal. Currentiy, mandatory orders can be obtained forcing the railway companies to relocate should they become totally unreasonable. . Contrary to the current legislation, railway companies may profit from relocation. The opportunity To obtain federal grants and The funding formula to assist railway relocations in urban areas wiili be reduced to the detriment of municipal ies.
