The court was told by Crown counsel Tom Bishop that the charges resulted from complaint Feb. 4, following a domestic dispute at the Fagan residence at 1934 Bobsein Cresent. Beryl Sturt testified that her 1977 Honda was badly damaged after she had an argument with Fagan. She told the court the windows of the car were smashed and added that the body of the car had been cut several times by a rectangular instrument. Sturt also testified that some of her clothes disap- peared after she had the argument with Fagan. Sturt estimated damage to the car at $2700 and told the court she estimated the ad of her personal effects to be close to $1,400. Conatable Hilla of the Terrace detachment of the RCMP told the court that he, along with two other police officers, went to Fagan's home and he saw the Honda with smashed windows. Hills stated that Fagan told him there was no need for the RCMP and sald Fagan added that “he was on his property and he could do ashe liked’. Hills testified that the officers saw black smoke from Fagan's chimney, and said that Fagan admitted he was burning Sturt's clothes. The constable stated Fagan told him he made the payments on the Honda and that he could do what he pleased with it. Constable Yeomans, also of the Terrace RCMP, told the court that he also saw black amoke coming from the chimney of the house, and stated that when he first arrived he heard breaking glass, and then saw Fagan gaing into his house. Constable Hines, another member of the Terrace detachment said he also heard breaking glass when he was approaching the Fagan residenc.. While testifying in his own defence, Fagan stated the officers “didn't get thelr story straight'’ and added that “there was no damage to the Honda at all” when the officers arrived on the scene, Fagan also stated that he did not feel the officers . would be able to see black smoke coming from. his chimney during the middle of a February night, and added that "they never asked me anything about : clothing" and sald even if he had burned the clothing he would not admit to the RCMP because “rm smarter . than that’. Fagan denied damaging the Honda, and stated that in any case he had bought Sturt.a new car and new clothes, Before finding Fagan not guilty, Collins stated ‘‘to aay the least, this is a strange case”. Collins stated the decision rested on whether the statements made to the police on Feb. 4 were thefacts, . or if they had been made out of bravado, and if the atatements made under oath were the truth. .“[ have my suspicions of course," stated Collins, “but that 1s not enough to justify a conviction". . Fagan pleaded guilty to another count of mischief, after he admiited to pushing over a 1965 International pickup that belonged to Sturt’s brother, Jamea Mc- Phergon, on the same night. On that charge, Collins ordered Fagan to pay a $150 fine, or spend 14 days in jail in default. The court was told Fagan had previously made reatitution to McPheraon for the damages. On another matter, Fagan pleaded guilty to a charge of theft under $200, The court was told by Bishop that the charges resulted from an incident May 21, when Fagan was alleged to have stolen gravel from a department of highways gravel pit. Collins ordered him to paya fine of $100, - membership; Contest winner Dean Kraeling, a grade 6 student at Clarence Michiel Elementary, has been named winner of the ‘Pool . Bishop added that Demeria was unable to make the ‘restitution because he was serving a jail sentence at the time, and Collina chose not to accept Demeria’ 8 guilty plea. Collins also noted Demeria was charged with the two counts of impaired driving and of driving with a blood alcohol reading oyer .08, in seperate incidents on April 27, April 29, and May 7. . ‘The court was also told that one charge of failure to appear was related to the charge of breach of con- ditions of probation, while the other three were in relation to the charges of impaired driving. “‘All the offenses took place over a ten day period," said Collins before passing sentence “so I’m going to treat the matter as a pattern of conduct.” Collins ordered Demeria, who has previous con- : yietions on similar offenses; to spend 90 days in jail on each of the impaired driving charges, and to spend 60 days in jail on over .06 charge, will all sentences to run concurrently, He also-ordered Demeria to spend 10 days in jail on each of the four counts of failure to appear, which were also to be served concurrently to the other charges. Another Terrace man, Lavern Charles Kretchmer, was sentenced to spend 45 days in the Terrace Com- ‘munity Correctional Centre, after being found guilty of impaired driving. The court was told by Bishop that Kretchmer had previous related convictions as well as being on probation, and Bishop added that the crown felt that “4ncarceration is called for in this instance.”’ Before passing sentence, Collins stated “I must follow the policy I have set for myself in cases of this nature, not only aga deterent to you, butas a deterrent to others.” Collins. noted that he had recommended to authorities at the correctional centre that Kretchmer be considered for the work-release program.
