Should the District determine that there are any defects in the installation, the company (once notified) will be required to correct these defects within 30 days. Maintenance Maintenance is specifically covered in section 5 of the Agreement. As you can see, we assume full responsibility for any cleaning, maintenance and repairs that might be needed. Further, if we fail to do so, we agree to reimburse the District for any expense to which it may be put as a result of our failure. You may also note that we agree that the benches will be cleaned no less frequently than three times per year. Should any of the equipment become damaged to the extent that it is dangerous to the’ public, we agree that we will repair or remove any such equipment within forty-eight hours of receiving notice to do so, otherwise the District will have the right to remove the equipment at our expense. While others may promise a regular maintenance program, we already have one. We have a full-time employee and service trick (see Appendix 3) dedicated to maintaining our benches on a year round basis. Routes © :ve been established in each jurisdiction in which we operate so that all of our benches are inspected a minimum of once every two months. If the problem is serious (ie. the equipment is somehow posing a danger), we would endeavour to respond to the problem the Same day we are made aware of it.
