The Terrace Standard, Wednesday, February 3, 1999 - A7 ¢ Abalone poaching results - in fines, houseboat seizure OFFICERS OF a northwest company have had forfeited a two-storey houseboat and other assets worth an estimated $150,000 after they were found guilty of various charges relating to the fishing of abalone. Richard Sandover-Sly was found guilty of fishing for abalone during a closed time and possession of abalone during a closed time and Sheila Sandover-Sly was found guilty of possession of abalone during a closed time. Their company, North Coast Marine Ltd., was also charged but was found not guilty, The two, from Terrace, were found guilty and fined $9,000 Jan. 21 after a nine-day B.C. Supreme Court trial in ‘Prince Rupert. A third person, Darrell Gordon Braun, a former employee of North Coast, was also charged and pleaded guilty partway through the trial, He was fined $7,000, ordered to pay $5,000 to abalone research and for- feited approximately $4,000 iu diving gear. Federal fisheries officer Dave Knapton said the forfeiture amount is the highest he’s ever heard of. And he said the fines are part of an increasing in- tolerance to poachers. . “Over the last cight years, the fines have gotten prog- ressively worse,’’ he said. “The department looks at this not very favourably at all.’’ Knapton wants to sell the seized hovseboal, a barge and dive gear and use the money for abalone research. The Sandover-Slys do have 30 days after the judgment to file an appeal. Abalone — an edible shellfish found in. coastal waters of Nurses tnk contract Northern California, B.C. and parts of Alaska — have been illegal to harvest in Canada since 1991 because of their limited numbers. Mr. Justice Selwyn R, Romilly was told fisheries officers began their investigation in Feb. 1997 after a truck being driven by Braun was stopped in Smithers. Two freezers containing 750 pounds of frozen abalone were discovered, Braun was then charged as was a fourth man, Doug Howarth, a passenger in the truck. He pleaded guilty soon after and was fined $5,000, The remainder of the charges and seizures using search warrants took place later that spring. Fisheries divers dis- covered approximately 6,200 abalone shells newly shucked on the barge, tug boat and two skiffs. Braun was a camp tender for North Coast, working and living on the house boat up until the search warrants were issued, Ron Gamble, the federal crown prosecutor for federal fisheries at the trial, said Braun was a defence witness for Ine (Sandover Slys and their company after he pleaded guilly. “The judge did not find Braun to be a credible witness at all,” said Gamble, Gamble added thal there was overwhelming circumstan- tial evidence connecting the Sandover-Slys to the charges that were filed.
