Eng., City Engineer ITEM I Re: Encrcachment of Donald Street on Private Property The legal survey for the restaurant site on the corner of Wilson and Donald Street indicates that Donald Street has been constructed in such a way that the east curb crosses the property line at an angle so that a sliver of the road is actually on private property. As the building itself is only five feet from the property line, the purchase of additional vight~of-way in order to accommodate the road would create a hardship for the owner of the property in that the building would then be non- conforming. The owner has suggested that he would be prepared to provide an easement in favour of the City to cover the encroach~- ment of the road if the City would be prepared to do some work on Wilson Avenue. The owner is concerned about the appearance of Wilson in front of his restaurant and would like to see the road paved to its full width and awroper curb constructed. The owner would then also be able to construct a sidewalk adjacent to the curb and provide proper landscaping between the sidewalk and his building. We estimate the cost of providing proper curb and gutter and paving an additional strip of road to the curb line, to be about $3,000.00. The other alternative which could be considered would be to relocate Donald Street. However, this alternative would cost almost as much as improving Wilson Avenue and therefore the latter solution is a better use of City funds. The Committee recommends that the City improve Wilson Avenue by paving a widening strip and providing curb and gutter for the frontage of the restaurant in exchange for an easement in favour of the City along Donald Street. The City would also be responsible for survey and legal costs to register the easement. Funds for this work can be taken from the $10,000.00 allocated in the Budget for uncommitted works. [2eeas
