RECOMMENDATION:

That City Council direct the Clerk's Office to inform
surrounding neighbours of this application and to place a
resolution on a subsequent agenda to consider approving the
application.

And that City Council adopt a resolution at a subsequent
meeting relaxing the requirements of the Zoning Bylaw No. 2240
Section 801, RS-1 Clause (7) Rear Yard Setback to permit a rear
deck to encroach into the required rear yard by 10 feet for Lot

40 D.L. 340, Grp 1, Plan 75763.

COMMENTS:

In this neighbourhood, due to the steep topography, City
Council has followed the practice of relaxing the rear yard
setback requirement for decks. Council's rationale for This
approach is to provide additional usable outdoor space for the
homes.

Applications for this relaxation are examined in terms of their
potential to overlook downhill! neighbouring houses windows.
