Both testified they were fishing in Canadian waters, as they were licenced to do, but denied they were in restricted zone 5-1. Through an interpreter, Karpitsky testified he showed Maratos on the chart that the Druzhba was not only outside the restricted zone, it was beyond the two mile buffer zone Soviet authorities have ordered their fishermen to observe. Maratos and two other men from the Tanu testified that soon after they boarded the Druzhba Sept. 17, they saw two marks on the chart inside the restricted. zone. Maratos said one position mark was 2% kilometres Hearst back in court SAN FRANCISCO (AP) — As Patricia Hearst’s lawyers prepared to a a ruling upholding her bank robbery conviction, hel onetime fugitive com- nions, William and Emily rris, prepared Thursday for a court appearance on charges of kidnapping her four years ago. Miss Hearst's lawyer, Al optimi: eventually would turned. Earlier, Miss Hearst, 23, assailed the 9th U.S, Circuit Court of Appeals, which upheld her conviction ednesday, as “‘incapable of rendering a purely just decision.” ; The last resort is the U.S. Supreme Court. She is free on $1 million bail. Lawyer James Browning said the government had no plans to seek her reim- prisonment until all appeals are exhausted. Meanwhile, the Harrises prepared to open their legal tile today in Oakland against charges that they kidnapped Miss Hearst on Feb. 4, 1974. The much-delayed preliminary hearing for the Harrises, among the few surviving members of the terrorist Symbiones Liberation Army, comes after a year-long fight by the couple to get lawyers of their choice appointed to defend them at public ex- pense, . The California Supreme Court agreed with the Harrises position: Last month Los Angeles lawyer Leonard Weinglass was named to defend Harris and San Francisco lawyer Susan Jordan was appointed counsel for Mrs. Harris. Weinglassrepresented the couple last year when they were convicted of kidnap and assault charges stemming from a series of SLA crimes in Los Angeles. They are serving 11 years- to-life sentences. over- ° inside the zone and the other was further in. Andrew Allan, a Tanu oiler, said he found puncture holes on the back side of the chart from where the marks were found, but Karpitsky testified the puncture holes . were made by Maratos. Pointing out locations on the chart to Judge Jack McGivern, Karpits testified through the in- terpreter that Maratos had apiece of on which he had the co-ordinates of the Russian position as determined on the Tanu’s Loran C navigational aid. The trawler master said Maratos explained Loran C was far superior to radar the method the Soviets had been using to fix their position. “Then he took a compass and started charting the pesitions,”” Karpitsky said. _ “The first point he has indicated here to the east of ‘the boundary of the zone 5-2 and therefore, in restricted zone 5-1. I noticed that his § hands were shaking quite a bit and he has carelessly made a puncture and that he has with a pencil circled that position. The Russian chart produced as evidence shows uzhba locations fixed by radar before the ap- prehension by Tanu. All the marks are outside the restricted zone. Maratos said the timed location marks were not there when he examined the chart soon after boarding, while Karpitsky testified the marks were placed n the chart at the times listed on it The case continues.
