RECOMMENDATION:

That City Council direct Tne Clerk's Office to intorm
surrounding neighbours of this application and to place a
resolution on a subsequent agenda to consider approving the

application.

And that City Counci! adopt a resolution at a subsequent
meeting relaxing the requirements of the Zoning Bylaw No. 2240
Section 801, RS=1 Clause (7) Rear Yard Setback to permit a rear
deck to encroach into the required rear yard by 8 feet for Lot
58 of Lot A, D.L. 340, Group 1, NWLD Plan 75763,

COMMENTS:

City Council has followed the practice of relaxing the rear

yard setback requirement for decks in this neighbourhood, due

to its steep Topography. The reasoning for this approach fs to
Vide additional usable outside rear yard area.

Applications for this relaxation are examined in terms of their
potential to overlook downhil | neighbouring houses windows.
This application meets the criteria. .
