AND WHEREAS the Grantor has constructed a building and other obstructions on the Statutory Right-of-Way and accordingly desires to modify the Statutory Right-of-Way. AND WHEREAS the Grantor and the Grantee have agreed to modify and amend the Statutory Right-of-Way in the manner hereinafter set out. NOW THIS INDENTURE WITNESSETH that in consideration of the gum of One Dollar ($1.00) now paid by the Grantee to the Grantor (the receipt whereof is hereby acknowledged) and for other valuable consideration the parties hereto covenant and agree with the other as follows: The Grantor and the Grantee hereby covenant and agree that, effective as at the date hereof, for the purpose of this modification, the Statutory Right-of-Way is hereby discharged and released as to that portion of the said lands shown outlined in heavy dark lines on that Plan of Right- ~of- Way certified correct by Brian Oke, BCLS on the 9th day of April and registered in the New Westminster Land Title Office on April 18, 1991 under Number LMP163, and for the purposes of this modification the Grantor, for himself, his heirs, executors, administrators and assigns, does hereby give and grant unto the Grantee, its successors and assigns, a Statutory Right-of-Way and the full, free, and unrestricted right and liberty to construct and maintain the aforementioned works in, over and upon ALL AND SINGULAR that certain parcel or tract of land and premises, situate, lying and being in the City of Port Coquitlam, in the Province of British Columbia, and being more particularly known and described as: That portion of the said lands outlined in heavy dark lines on that plan of Right-of-Way certified correct__by._David—LePatourel, BCLS, ITEM | PAGE 52/125/54754-C
