May 28, 199 1/134 These areas may be designated for the following purposes: Protection of the natural environment, Protection of development from hazardous conditions, Protection of Provincial or Municipal Heritage sites under the Heritage Conservation Act, Revitalization of an area in which a commercial use is permitted, if the area has been designated for that purpcse by the Minister, or Establishment of objectives and the provision of gu delines for the form and character of commercial, industrial or mul :i-family residential development. Impact of Development Permit Area Designation Unless otherwise specified under Section "V", 1.3 'Exem tions' a Development Permit must be obtained prior to any develo ment or subdivision of land taking place within a Development Fo:rmit Area. A Development Permit may vary or supplement Land Use 5; laws and regulations related to Land Use designation and subdivision and development requirements, but cannot vary or supplemen' the Use or Density of the land from that permitted in the Bylaw. Where t.e land was designated a Development Permit Area for the protectio1 of development from hazardous conditions, however, the use or density may be varied but only as they relate to health, safety or protection of property from damage. In addition, Development Permits for a specific purpos: can establisk additional restrictions as noted below: a. Within Sevelopment Permit areas for the protectico: of Natural Environment or the protection of development from hazardous conditions. The Development Permits can: Prohibit the development in lands which may ve subject to flooding, mud flows, torrents of debris, erosion, land slip, rock falls, subsidence, tsunami or avalanche; Require, in an area that the permit designate as cintaining unstable soil or water which is subject to degradation, that no septic tank, drainage and deposit fields, or irrigation ox wate1 systems be constructed; iii. Require that natural water courses be preserved or .edicated, and works be constructed to preserve or enhance natural water courses; Specify areas of land that are located above the na ural boundary of the streams, rivers, lakes or the ocean that shall .emain free of development. except in accordance with any condition: contained in the permit; and
