THE CORPORATION OF THE CITY OF PORT COQUITLAM BY-LAW NO. 1271 A By-law to acquire a Sever Right-of-Way by Expropriation for the use of The Corporstion of the City of Port Coquitlam. WHEREAS the Hunicipal Council of The Corporation of the City of Port Coquitilan is duly authorized and empowered to construct, operate and maintain a sanitary sever system for the benefit of the inhabitants of the nunicipality; AND WHEREAS the Municipal Council deems it necessary to acquire the Right-of-Way hereinafte. referred to by By-law pursuant to Section 531(4) of the Municipal Act, Chapter 255, R.S.D.C., 1960 and Amendments thereto for the aforeseid purpose; NOW THEREFORE the Municipal Council of The Corporation of the City of Port Coquitlam, in cpen meeting assembled, enacts as follows: 1. Pursuant to Section 531(4) and subject to division (4) of Part XII of the "Municipal Act" R.S.B.C., 1960 and Amendments thereto, the Municipal Council of The Corporation of the City of Port Coquitlam is hereby authorized, by its servants, to enter upon an! the Council does hereby exproprista, break up, take, or enter into possession of and use for the purpose of a Right-of-Way, io the form hereunto annexed and made part of this By-law for the purpose of e sewer line Right-of-Way in the City of Port Coquitlan, the following described lands and prerises: All and Singular that certain parcel or tract of land and premises situate, lying and being in the City of Port Coquitlam, in the Province of British Columbia, and being more particularly known and described as: That portion of Lot Twenty (20) of the South East Quarter of Section Twelve (12) Township Thirty-nine (39), Plan 11116, EXCEPT; Firstly, Parcel “A (Explanatory Plan 23021); and; Secondly, Plan 40387, New Westminster District, as shown outlined in Red on Plan of Right-of-Way deposited in the Land Registry Office at the City of New Westminster, under Number 44609. 2 Thia By-law shall not coma into effect until it has been published in the Gazette and once in a newspaper published or circulated in che City of Port Coquitlam and a certified copy of the By-law has been filed in the Land Registry Office, in the City of New Uestminster. (hereinafter called "The Grantor") OF THE FIRST PART AND: THE CORPORATION OF THE CITY OF PoRT COQUITLA'N, a Municipal Corporation having 4ts municipal offices in the City of Port Coquitlam, in the Province of Eritish Coluxbia. {hereinafter called "The Grantee") OF THE SECOND PART WHEREAS the Grantor is the owner in fee of those certain parcels or tracts of land and premises, situate, lying and being in the City of Port Coquitiam, in the Province of British Colundia, and being more particularly known and described as: Lot 20, South-east Quarter Section 12, Township 39, Plan 11116, EXCEPT; Firstly, Parcel "A" (Explanatory Plan 23021); and; Secondly, Plan 40387, New Westminster District (Hereinafter called the said lands) AND WHEREAS to facilitate the installation of sewerage works the Grantor has anreed to pernit the construction by the Grantee of the aforementioned works on the said lands, and to grant for that purpose the right-of-way hereinafter nentioned.
