Townhouse Development Site on Lobb Avenue Recommendation: That the Mayor and City Clerk be authorized to execute the following documents which will be registered against Lot 1, District Lot 239, Group 1, Plan 76127, NWD: 1. Modification of existing Section 215 Covenant No. AA206724 (re: flood-proofing). Ze A new Section 215 Restrictive Covenant for a common access to Pitt River Road. 7 Background and Comments: Attached to this report are the two aforementioned documents intended to be registered against the Inlet Realty townhouse development site on Lobb Avenue. The first document, a modification of an existing Section 215 tlood-proofing covenant, will permit the construction of the entrance, foyer and landing areas below the established flood-proofing elevation of this property. The developer has requested and already has obtained approval from the Ministry of Environment and Parks for this modification. Normally, the City Is not involved in these types of covenants. However, since the original document names the City as an interested party, a request is therefore before Counci! to approve this. modification to the covenant. The second document, is a combined easement and Section 215 Covenant, providing for a common access road through a portion of the townhouse site connecting to Pitt River Road. This document has been prepared at the City's request for two reasonSe Firstly, during the Public Hearing for the rezoning of this property, Council endorsed the concept of an access onto Pitt River Road from the site to alleviate The potential tratfic problem on Lobb Avenues Secondly, since this development is a phased strata, this document will satisfy The concern of the Approving Officer in that a common access To Pitt River Road from Phase | is preserved in Phases || and lll.
