Terrace Co-op Home Centre 2912 Molitor St., Terrace 635-9595 Go get him, Killer! The noise in the all-night café was deafening. “Hey, Lancel” the boss shouted, “Get this last batch of dishes washed before your shift is over.” Fourteen year-old Lance mumbied unmert tionables under his breath, “| Shoulda listened to Ma and stayed in school, This job is a dead-ender, and It sure ain't gonna make me rich.” Lance finished washing the last dish, put his bomber jacket on and ambled out of the café into the night. As he crossed the street, his eye was caught by a small car parked up against a building. “Hey, look at that. The rear windaw’s bro- ken. It would be a sin to pass this up.” Lance's eyes darted up: and down the street, No one, Lance smiled, “This Is gonna be niilliliilice and easy. A few extra bucks is all 1 need to take Sally out for a beer." ; As Lance poked his hand through the bro- ken window to open the door, patrol car num- ber 18 got a call from dispatch. “Calling car 18, calling car 18. We have a report from a Parksville Road resident that a young kid is attempting auto theft, Check it out.” Officer Smithson and his loyal K-9 part: ner, Killer, zaomed over to the location. They got out and tiptoed cautiously to the car, Lance was in the front seat, rummaging through the glove compartment. “Get out of the carl Hands on top of your head. Don't resist or |'ll release my dogl" Suddenly, there was pandemonium. A wild scuffle took place. ‘OU BE THE. JUDGE BY CLAIRE BERNSTEIN BASED ON _ ACTUAL COURT CASES “Get your dog off mel He's tearing me to pieces!” ’ When: it was all over, Lance was arrested for attempted car theft. Lance was a mess, He had several deep lacerations and puncture wounds on his leg from Killer’s bites, He also suffered a broken right arm and cuts to his face. Lance sued Officer Smithson for causing him injuries due to his excessive use cf force. In court, Officer Smithson and Lance told two versions of the facts. Groaning underneath his bandages, Lance presented his case. “Your Honour, it was not necessary to have a police dog bite me in order to arrest me! The moment | stepped out of the car Killer bit mel | ran away so Killer wouldn't bite me again. |! have wounds on my thighs two inches long. Make the police pay for this!" Officer Smithson balked. "Your Honour, Killer only bit Lance when he tried to escape. Our use of force was brought on by Lance's own criminal actions - first the attempted car theft, then the escape attempt." Officer Smithson gritted his teeth in frustration. “This is ridiculous! A kid tries to steal a car and WE'RE supposed to pay HIM damages?!” Should Lance be compensated for his Injuries? You! Be the Judge. Then look ‘ betow for the decision. SPONSORED BY ys LAWYERS “Helping People Cope with the Legal System”
