Right of Way Encroachment

RECOMMENDATION:

The roof overhang be allowed to encroach the statutory Right of Way.
Allow a concrete driveway with the stipulation that there be a
construction joint along the entire length (both sides) of the Right of
Way, or use asphalt instead of concrete.

BACKGROUND :

A lot on Ricard Place (#1275) has a 3m Sanitary Right of Way traversing
through it. See attached drawing. This Right of Way location severely
restricts the building envelope size, consequently the house being built
is long and narrow. As shown on the drawing the roof overhang (1'6") will
encroach in several locations. Also the garage entrance is at the side as
opposed to the front. The driveway will have to cross the Right of Way.
All the existing driveways in this subdivision are constructed with
concrete. As is stated in the Standard Right of Way Agreement, no
concrete driveways, patios etc. be allowed to cover a Right of Way.
