Agreement for Trenton Sewerage Works Project (Public Works Committee Meeting of February 23, 1988) Recommendation: That the Mayor and City Clerk be authorized to execute the attached agreement with Canadian Pacific Ltd. for the purpose of installing a 350 mm carrier pipe for a sanitary force main beneath the C.P.R. tracks. Background and Comments: The design for the Trenton Sewerage Works Project requires that a section of the sewer force main be installed beneath the C.P.R. tracks as shown in the drawing accompanying the attached C.P.R. Agreement. Although this project has been placed on hold temporarily by Council if would be wise to have this piece of paper work tidied up in preparation of recommencing this project should Council wish to do sO- In cansidering the recommendation Council should be aware of the following highlights paraphrased from the contents of the agreement: 1. The City will indemnify the railway company against all potential! costs and liabilities which may arise 4s a result of the proposed construction worke The City will be responsible to pay the costs of having a supervisor from C.P.R. available to inspect the site while the work is being undertaken. The initial application fee for this agreement is $80 with a perpetuity fee of $10 per year for as !ong as the agreement is in effect. Should tne railway company at ary time request that the works to be installed beneath the tracks be removed the City shall comp!y and assume all of the associated costs. The agreement can be terminated at any time by eitner party upon giving the other party three months prior notice. ‘ 34 ~|-
