Kiecken Acting City Engineer SUBJECT: Standard Right of Way Agreement For Highway Purposes (Public Works Committee Meeting April 17, 1990) RECOMMENDATIONS 1) That the attached Right of Way Agreement drafted by the City's Solicitor be adopted for use whenever a Statutory Right of Way is required for Highway or Public Access purposes, and 2) That Council authorize the Mayor and Clerk to execute without further Council approvals all future Statutory Right of. Way Agreements which are identical in wording to this Agreement. BACKGROUND AND COMMENTS: There are two developments currently in progress where the City has agreed to accept a Right of Way for highway purposes in lieu of road dedication to avoid adversely affecting lot coverage and building setbacks in the developments. One of these involves a 3 metre x 3 metre corner cutoff at the intersection of a lane with Coquitlam Avenue just east of Flint Street to accommodate a portion of the paved road surface, and the other a 2.13 metre widening along the south side of Pitt River Road to the west of Shaughnessy Street to accomodate a sidewalk and future road widening. . The City's standard Right of Way Agreement is not suitable for this purpose in that it has no provisions for granting the right of access to the public. The City’s Solicitor, Grant Anderson, has drafted the attached form of agreement , and the Committee recommends that the form be adopted for this purpose and that Council authorize the Mayor and Clerk to execute future Right of Way Agreements which are in this form. It is not anticipated that the use of this form of Right of Way would become widespread, since it is more desirable to obtain the road dedication where possible as our Solicitor has noted. D.G.
