tha cast of a community facility cn this Site, provided +hat such facility is

designed and scheduled for camplation within 2 years of the issuanca of a

building permi+ far THe 1000+h dwelling unit within the development and that

the facility is ef a value equal To or greater than the Oeveloper'ts

cantribution; provided That in the event shay TRe City has nor substantially

completed +hijs facility within +he Two year period, the contribution shal! be

refunded without interes’,
