EHERFAS the "City of Port Coquitlam Zoning By-law, 19€9, No. 918" as anended designates certain areas of land within the zouea set out therein as “Development Areas"; AND WHEREAS the lands hereinafter described are situate within an area 60 designated; AND_BEREREAS the Owner of the said lands has wade application for a Land Use Contract to authorize works, development, and use some aspects | of which are not in conformity with the relevant Gity By-laws as the same apply to the zone in which the said lands are situate; AND WHEREAS che Council hae given due regard to the following considerations: 1. (a) the promotion of health, safety, convenience and welfare of . the public. : (b) the prevention of the overcrowding of land, and the preservation of the amenities particular to any zone. (c) the securing of adequate light, air and access. (é) the value of the land and the nature of its present and prospective use and occupancy. (e} the character of each zone, the character of che buildings already erected and the peculiar suitability of the zone for particular use. , (£) conservation of property values. 2. (a) development of areas to promote greater efficiency and quality. . (b) the izpact ef development on present and future public coste. (c) the betterment of the environment. (4) the fulfillmenc of community goals, {e) the provision of necessary public space. and it is deemed desirable to enter into Land Use Contract No. 23 ia the fore and to the extent heretnafter provided; NOW THEREFORZ the Municipal Council of The Corporation of the City of Port Coquitlam, in open peeting assembled, enacts as follows: The Council of The Corporation of the City ef Port Coquitlam is hereby authorized and empowered to enter into a Land Use Contract with Dawnen Compt ruction Led., 735 Clark brive, Vancouver, B.C. -~2- in the form and to the extent set forth in “Land Use Contract No. 23", which is the Schedule hereto d and wade part of this By-law. 2. The said Land Use Coatract No. 23 shall extend to and shall regulate the development and use of the lands described therein. 3. Land Use Contract No. 2? shall have the force and effect of a Teatrictive covenant running with the landn described therein and shall be registered in the New Westainster Land Registry Office by the City. 4 Thla By-law may be cited for all purposes as "Land Use Contract No. 23 Authorization By-law, 1977, No. 1542". .
