Kirk November 9, 1990 City Administrator File No. 55/90 Carlos Felip Director of Planning 3373 Raleigh Street Application for Development Variance Permit Planning and Development Committee — November 13, 1990 RECOMMENDATION : That Council P8SS a resolution authorizing the Planning Department to prepare Development Variance Permit No. 55/90 subject to: The applicant submitting a Rezoning Application to rezone the Property from RT-1 to RS-23 and; 2. The applicant providing a written statement acknowledging that the rezoning will prevent the construction of a duplex on the properties. PROJECT DESCRIPTION: The applicant bought the Property at 3373 Raleigh Street with the intention of building two Single family houses. The property is made up of two 33' lots. When the applicant subinitted for a building permit, he was advised the zoning on these properties was RT-1 (Iwo-Family Residential). DISCUSSION: Single family houses on RT-1 property require sideyard setbacks of not less than 1.8 m (5.91 ft.) on each side; on 10 m (33 ft.) lots the building width would be 6.4m (21 ft.). In RS~2 zoned Property, the sideyards are only 1.2m (3.94 ft.), therefore a 7.6m (25 ft.) building is possible. The applicant has applied for a development variance to vary the sideyard setbacks from 1.8 m (5.91 ft.) to 1.2 m (3.94 ft.). The Planning Department does not have a problem granting the variance of interior sideyard setbacks Providing that the applicant rezones the property from RT-1 te RS~2 (Small Lot Residential), which will mean in the future the property owner will not be able to build a duplex on these properties.
