RESTRICTIVE COVENANT - DEVELOPMENT AT 788 CETADEL

That Council authorize His Worship the Mayor and the Clerk to approve the
attached Geotechnical Restrictive Covenant over Lot "A", DL 344, Group 1,
N.W.D., Plan NWP 87543.

To discharge the Geotechnical Restrictive Covenant over Lot "A", DL 344, Group
1,N.W.D., Plan NWP 87543 registered in 1991.

Council previously approved this covenant in 1991, however after a recent study the owners

decided that the boundaries in the present covenant could be extended further out. The reason
for the covenant was because of the steepness of the slope at the back of the property. The

whole of the covenant remains the same except for the Soils Engineering report and an updated
land surveyors plan.

Committee approved this amended covenant in principle on December 8, 1992 but noted that
they would like to see a statement added that the owners would be responsible to construct a
fence where the steep slope creates a hazard. This paragraph 1(e) on page 5 of 7 was included.
If Council approves this covenant it will just replace the present registered copy as an

"Amended" copy.
