~ Happy With Heroin Treatment Changes

The provincial govern-
ment was commended
Wednesday by a spokesman
for the B.C, Branch of the
Canadian Bar Association
for amending key sections of
Bill 18, the Heroln Treatment
Act.

But the spokesman --
Stephen Gill, chairman of
the Bar Association com-
mittee on Bill 18 ~ said the
government still hasn't gone
far enough in meeting the
objections of the lawyers and
preserving the rights of an
individual,

Gill said the government
moved in the right direction
with amendments which
removed the right of the
program's director to make
a committal decision and to
require instead an ap-
plication for committal in
the Supreme Court.

In addition, Gill sald, the

constitutional problen
remains, We recommend
that the government initiate
a test case to ensure this is
not, infact, criminal law and
therefore unconstitutional
before it spends huge sums
of money on this pragram.,”
Gill pinpointed other
problem areas that still exist
with the amended Bill.
“The new examination
procedure does not require
all ‘members of the
evaluation panel to per.
sonally examine the patient.
How can a proper medical
and psychological
examination — as required
by the Bill -- be done in the
circumstances?”

Gill said the definition
sections have been modified,

the Board of Review are
unchanged. This means the
Board can still extend the
time in confinement without
appeal, and this, ‘too, would
apply to voluntary patients,’’
Gill said.

changed, and should have

“The Bill is improved by
the proposed amendments,"
Gill said, “but it still has
many ‘deficiencies, This
reflects a rush job, without
proper consultationo
consideration of the terms or
procedures,

“We urge a few menths'
delay so we can work over
the summer with the
Minister to make the Bill
workable,’’ Gill said.
