6. ll. The City Engineer, the Bylaw Enforcement Officer and all City employees under their direction may at all reasonable hours enter upon any land or premises in the City to determine if the provisions of this bylaw are being met. No person shall obstruct such entry. If contaminated soil is deposited on land contrary to this bylaw, the owner of the land shall have the contaminated soil remediated to a non~-contaminated condition or removed from the City with 7 days of notice to do so from the City Engineer or Bylaw Enforcement: Officer. On default by the owner, the contaminated soil may be remediated or removed by the City at the expense of the owner of the land and the costs shall be recoverable in the same manner as municipal taxes. PENALTY Every person who violates any provision of this bylaw commits an offence punishable on summary conviction and shall be liable to a fine not exceeding $10,000.00. SEVERABILITY If any section or lesser portion of thia bylaw is held invalid, it shall be severed and the validity of the remaining provisions of this bylaw shall not be affected. SCHEDULES Schedule "A" attached to this bylaw is incorporated in and forms this bylaw. CITATION This Bylaw may be cited for all purposes as “Contaminated Soil Prohibition Bylaw, 1992, No. 2664”.
