upon completion of the Pumping Station works and
acceptance by the City, the City shall pay to the
Developer up to $37,500 out of the Provincial
Sewer Grant received in relation to the Pumping
Station, it being understood that such grant is
258 of the cost of the Pumping Station and
provided that no payment is due hereunder unless
and until the City receives same from the

Province;

for five years, on each anniversary of the date of
Certificate of Completion of the Pumping Station,
commencing one year after the date of the
Certificate of Completion, the City shall pay to
the Developer up to, in cumulative total, the
difference between the maximum cost calculated
pursuant to section 8{a) and the amounts payable
or to be credited to the Developer pursuant to
Sections 8(b), (c) and (d), without interest, the
maximum annual payment being limited to
development cost charges contributed to the City
during that year in the Sanitary sewer benefitting

area that includes the Lands: and

any balance outstanding to the maximum payable
pursuant to Section $8{a) due to insufficient
collection of development cost charges shall be
paid on the fifth anniversary of the date of the
Certificate of Completion of the Pumping Station.
