BACKGROUND: Zoning Amendment Bylaw No. 2787, which is attached as Appendix I, was prepared to amend the flood proofing regulations contained within the City's Zoning Bylaw and to make them consistent with Ministry of Environment guidelines. Certain areas of the City will no longer be under the Ministry of Environment's jurisdiction, so the City's bylaws must be expanded in scope to account for these lands. On June 14, 1993, Council deferred Third Reading of Bylaw 2787 for “additional information on Floodplain Management in neighbouring municipalities and municipal requirements for implementation". Specifically, questions were raised about: 1. Whether liability would be incurred if the City did not enact such a - Bylaw, and; Whether the Bylaw could include a "grandfather clause" to allow existing buildings to be rebuilt on their current sites at their current elevations if they are demolished or destroyed. ai PAGE v6 q Gont'd.../2
