Bar owners say business is way u Smoke By ALEX HAMILTON A SIGN placed on the rear window of a local vehicle last week depicting a cer- tain crass middle finger gesture with the wards: “WCB smoke this” about summed up the sentiments. held by the majority of local ‘smokers, bar and restaurant owners, But for the first time in nearly three months, cigar- ette smokers and pub staff were happy March 22 when a Supreme Court justice rejected the pro- vince’s stringent no-smok- ing regulations. Ashtrays were back on bar tables and local smo- kers puffed away with a vengeance last week after Justice Sunni Stromberg- Stein’s rejected the Work- ers’ Compensation Board’s non-smoking regulations, enforced since Jan. 1. The judge struck down the WCB’s smoking ban in certain facilities, like bars and restaurants, because the regulations were enac- ied without properly con- sulting the hospitality in- dustry. The ruling means all fines and penalties levied against establishments that actively defied the ban are rejected. That’s good news to Skeena Pub owner Norm Zlolikovitz, who was threatened with more than $20,000 in penalties ~ the highest in the province — for defying the ban for a month. “I guess [the. WCB] got egg on their face now,” he said, relieved with the judge’s ruling. “I hope everyone sues them for the business they lost over the past three months.” Zlolikovitz initially ig- nored the ban, which was set up to protect workers from the hazards of sec- ond-hand smoke, because he objects to the govern. - ment telling Him how.-:to., tun his business» He was forced ta comp- ly after receiving multiple - potential penalties. Owner of’ the Eddy Pub, Gus Gerdei, said business has been booming since he put -ash- trays back on tables. “Thursday was the first steady day we've had in a long time,” Gerdei said of the day after the ruling came down. “It was prob- ably our best week for bu- siness since the regula- lions were put in place.” Gerdei said now the pressure is off for tourist season. He feared offending all of his tobacco-loving Eur- opean customers who fre- quent his pub every sum- mer. “IT was worried about how I was going to tell the tourists and the lodge ow- ners they cauldn't smoke in here. A lot of them wouldn't want to come back the next year if they knew they couldn't smoke any where.” George’s pub manager Darren Eves said his busi- ness also jump-started last week, “There are.a lot face back here we haven't seen for a long time,”Eves said. He's already re-hired an employee who was let go because his weekday busi- ness had been reduced toa. trickle.
