[New way needed to settle land claims By JENNIFER LANG THE KEEPER of B.C.’s treaty process is calling for an overhaul in the way agree- ments with First Nations are negotiated. The BC. | Treaty Com- mission has just released a review of the eight- year-old sys- tem that has so far failed to result in a single treaty. “There is a need for urgent action,” BCTC com- missiones Debra Ha- * muse said Debra Hanuse during a stop in Terrace recently, “Public support for this process might be undermined if change isn’t realized soon.” Three native bands have recently with- drawn from negotiations and more are threatening to pull out, tao, she said, Plus, B.C.’s Liberal government has suspended several areas of negotiation from the table, including aboriginal self government, until a province-wide refer- endum takes place, Hanuse said the proposed treaty refer- endum puts the process in further jeopar- dy because it causes yet another delay. Treaty negotiations in B.C. have been at a virtual standstill for the past 11 months because of the federal and provin- cial elections. The review, included in this year’s BCTC annual report, contains a set of suggestions aimed at making the treaty process more effective. The BCTC says agreements should be built step-by-step rather than through a “big bang” approach resulting in a com- prehensive treaty after many years of ne- gotiations. Instead, First Nations should be able to negotiate “slim” agreements that won’t take as long ta complete, and negotiators should be allow to work out more interim agreements on issues related to lands and resources. oo Another tool the BCTC says would speed things up-would be to intensify high-level negotiations with federal and provincial ministers, and First Nations re- presentatives. Treaty issues that are common to all tables could be settled by this group. Meanwhile, individual tables could continue working on incremental agree- ments that go into effect much more quickly. “We need to see results along the way,” Hanuse said. “British Columbians want to see results right now.” The review also recommends giving First Nations the option of taking a time oul from negotiations to develop human resources — without getting deeper into debt. Hanuse said the BCTC has found a large gap in vision between what First Nalions -want included in a final agree- ment — and what the two senior govern- ments are prepared to agree to. The review also says government ne- goliators should be more candid about what's on the table. For example, if government negotia- tors are using a population-based formula to determine the amount of land and cash in a final agreement, First Nations should be told up front. “No one’s come right out and said that’s what happening,” Hanuse said.
