October 28, 1991/250 A Public Hearing pursuant to Section 956 of the Municipal Act was held prior to the Council meeting of the Corporation of The City of Port Coquitlam held in the Council Chambers, Port Coquitlam City Hall, 2580 Shaughnessy Street, Port Coquitlam, B.C. on Monday, October 28th, 1991 at 7:30 Pollie His Worship Mayor L.M. Traboulay and Aldermen M.D. Gates, J.J. Keryluk, M.J. Gordon, R.H. Talbot, and M.R. Wright in attendance. Also in attendance were Deputy Administrator City Clerk R.A. Freeman, City Engineer I. Zahynacz, Director of Planning C.R. Felip, Director of Building Permits and Inspections J. Shardlow and Secretarial Assistant to the City Clerk S. Rauh. ZONING PUBLIC HEARING: His Worship Mayor L.M. Traboulay advised the following proposed Bylaw would now be considered: Bylaw No. 2621; To repeal the present Section 508 "Building Per Parcel” of the Bylaw and to substitute the following regulations: "308 PRINCIPAL RESIDENTIAL BUILDINGS Except as otherwise provided in this Bylaw, only one principal building used for residential purposes is permitted on a lot. CONSTRUCTION OF SUBSTITUTE DWELLING Notwithstanding any other provision in this Bylaw, upon compliance with this section the owner of land in an A-1 » RS-1, RS-2, or RS-3 zone may construct a new single-family dwelling on that land whtle that owner continues to occupy an existing dwelling on the same lot. Prior to issuance of a building permit for the new dwelling, the owner shall execute and register a covenant in favour of the City pursuant to Section 215 of the Land Title Act, prohibiting residential use of the existing dwelling upon occupancy of the new dwelling and requiring demolition and removal of the existing dwelling within 21 days of occupancy of the new dwelling. The covenant shall: (a) empower the City to enter the land and demolish and remove the existing dwelling upon failure of the owner to comply with the covenant; (b) require the owner to indemnify the City against any costs incurred by the City in enforcing the covenant; and —_ (c) be registered in priority to any financial charges on title to the land. Prior to issuance .of a building permit for the new dwelling, the owner shall deposit with the City security in the amount of $5000.00 for demolition and removal of the existing dwelling, in the form of cash, a certified cheque or irrevocable letter of credit."
