A8 | Terrace Review — Wednesday, May 8, 1991 __ Sustut dispute continues to simmer -[- Court action "= pending “The Village of Hazelton may take the provincial government to court for issuing the Sustut-Takla forest licence to a Prince George | consortium in 1988. At the April 20 board meeting of the Kitimat- Stikine Regional District, Hazelton mayor Alice Maitland asked for support -from other directors in helping to raise $11,000 to $15,000 needed for legal fees. The regional district has placed the request on hold for a month and asked that Hazelton demon- strate unified community support | in the Northwest in making the challenge. The regional district gave Hazel- ton $2,000 several months ago as part of the money required fo geta legal opinion on the chances of success in the couris. Maitland says they now have that opinion: the government’s decision may have been wrong and the timing of a challenge now is good, She has asked everyone with a vested interest in overturning that decision to help. "So we have at least some access [to the timber licence],” she told the board last Saturday. According to District of New Hazelton director Pete Weeber, however, there may not be univer- sal support in going to court. Weeber told the board that he had been instructed by his municipal council not to support the chal- lenge at this time because it was like "flogging a dead horse". With this, Kitimat director Ray Brady said, "It’s difficult to sup- port when one community is say- ing their not going to because it’s flogging a dead horse." He added, however, that if the Village of Hazelton could get support from other communities, like Smithers for example, he was prepared to support the challenge. Maitland suggested Kitimat should make a decision based on the merits of the case and not wait for others to make that decision for them. Brady, however, entered a tabling motion to their May meeting.
