AND WHEREAS the Clty has agreed to collect a portion of the costs of
the trunk water and trunk Sewer mains from other lands benefitting from these

mains and to refund to the Developer the moneys so collected;

AND WHEREAS the Developer desiras to stage the subdivision of the

lands over a number of years and to make provision for the orderly extension of
the services and amenities to the vartous phases [n coordination with the
subd iv Islor;

NOW THEREFORE this agreement witnesseth that in consideration of the

pramises and {n consideration of the Agreement by the City te permit the.

construction of the works, the Developer and the City cavenant and agree as

In this agreement unless the context otherwise requires:

"eCity Eng Ineer" shall be construed to mean and {nelude the City
Eng [neer for the City and his duly author{zed assistants. |

"Complete" or 'Complation' or any varlation of these words when used
with raspect to the work or works referred to hereltn shall. mean
completion to. the satisfaction of the City Engineer when so certified
by him tn writing.

"Contract" or "Agreement" shall be construed ta mean tnis Agreement. .
"Work! or '"Workstt or any vartation of these words shall be construed
To maan and Include ali work required te ba done for the setting out,

the execution and the completion of this Contract to the satisfaction
of the City. :

The City agrees that the lands may be developed. in several phasas and

that subdiviston approval for any phase will not be unreasonably

withheld, provided that
