Freeman, City Clerk RE: Lot 34, Block 4, Northwest Quarter, Section 6, Township 40, Plan 2324 Ax the date of writing this memorandum it is our expectation that the above neted property (which is a small 33 foot lot located within the City's proposed Feological Reserve area) will be offered for sale at the tax scale to be held on Monday, Octcber 2, 1972 and that there will have been no bidder for the preperty and the title will thus pass to the City. ‘She property is presently in the name of Mr. Richard E. Evans, who has been deceased for some time, and the estate is apparently quite complicated and the property has been permitted to go to tax sale in order that the title may be cleared. After title has passed to the City immediately following the tax sale there is a one year redemption period provided by statute and the trustees in charge of the estate have agreed that the property will not be redeemed if the City wish to retain -ownership and will pay the sum of $2,000. for the property. Technically, this would “be accomplished by paying the $2,000. to our solicitor's trust account where it would remain until the expiration of the redemption period on October 1, 1973 when it would then be transferred to the Estate Trustees’ Solicitor's Trust Account. This procedure must, of ccurse, be approved by the Council and if the Council wish tu do vo might we suggest that the following resolution be passed: " that the sum of $2,000. be forthwith paid Ly the Corporation of the City of Port Cocuitlam to the trust account of Mr. A.K. Thempson, barrister and Solicitor, F.O. Bo: 100, white Rock, B.C.; . THAT Mr. Thompson be instructed to retain the said amount in his trust account until the Registrar of the New Westminster Land Registry Office issues a Certificate of Indefeasible Title in the name of the Corporation of the City of Port Coquitlam with respect to Lot 34, Block 4, Northwest Quarter, Section 6, Township 40, Plan 2324, New Westminster District; THAT upon title to the said Lot 34 becoming registered in the name of the City as aforesaid Mr. Thompson be and ho is hereby instructed to transfer the said sum of $2,000. from his trugt account to the trust account of Mr. John R.E. Medland, barrister and Solicitor, 15th Tleor, Two Bentall Building, Vancouver 1, B.C.; ANU THAT Nis Worship the Mayor and the City Clerk or His Worship the Mayor and the City Treasurer be authorized to execute such deeds, meps, plans, cheques, etc. as nay necessary or requisite therefore and to affix the Corporate Seal thereto as reguired." tN LY TAR, City Clerk
