THE CORPORATION OF THE CITY OF PORT COQUITLAM BY-LAW NO. 1380 : A By-law to authorize the City to enter into Land Use Contract No. BHEREAS the "City of Port Coquitlam Zoning By-law, 1969, No, 918" a6 anended designates certain ‘areas of land within the zones ‘set out therein as "Development Areas"; ~ AND WHEREAS the lands hereinafter described are situate within an area so designated; AXD WHEREAS the Owner of the said Lands has wade application for a Land Use Contract to authorize works, development, and use sone aspects of which are not in conformity with the relevant City By-laws as the same apply to the zone in which the said lands are situate; AND WHEREAS the Council has given due regard to the following considerations: : 1. (a) the prorotion of health, ‘safety, convenience and welfare of the public. (b) the prevention of the overcrowding of land, and the preservation - of the amenities particular to any zone. . (c) the securing of adequate light, air and access. (4d) the value of the land and the nature of ite present and prospective use and occupancy. {e) the character of each zone, the character cf the buildings already erected and the peculiar suitability of the zone for particular ¥ use. the conservation of property values. the development of areas to Promote greater efficiency and _ the impact of development on present and future public coste. the betterment of the environment. the fulfillment of community goals, the provision of necessary public space. and it is deened desirable to enter into Lana Use Contract No. 12 in the form and to the extent hereinafter provided; NOd THEREFORE the Munic{pal Council of The Corporation of the city of Port Coquitlam, in open meeting assembled, enacts as follows: 1. The Council of The Corporation of the City of Port Coquitlam is hereby authorized and empowered to enter into # Land Use Contract vith ee OL - Ideal Holdings Ltd., 1776 Nanaimo Street, Vancouver, B. C. in the form and to the extent set forth in “Land Use Contract No. 12 which ia the Sch a dule hereto and made part of this By-law. 2. The said Land Use Contract No. 12 shali extend to and shall regulate ‘the development and use of the lands described as? , “North 128" Lot 12, Block 4, District Lot 379, Group One, Plan 1213, New Westminster District 3. Land Use Contract No. 12 shall have the force and effect of a restrictive covenant running with the land described in Section 2 hereof end shall te registered in the New Westuinster Land Registry Office by the City. 4. This By-law way be cited for all purposes as "Land Use Contrsct Ne. 12 Authorization By-law, 1975, No. 1380", Read a first time by the Municipal Council this Twelfth day of May, 1975.
