DBLEGrATION FROM INTRAWEST Corruuittee received delegations from Intrawest and CP Rail to discuss the subdivision of the Intrawest Property to CP P.ail. CP Rail presented three issues of concern regarding the draft restrictive covenant on the subdivided lot. The first concern was with section 1 of the covenant regarding building prohibition. CP indicated that they would require the contruction of enclosed structures such as tool sheds on the parcel. CP was willing to put wording in the covenant which would limit the size and use of the enclosed structures. Committee asked CP about the possibility of explosions within the enclosed structures. CP said that all health and safety hazards would be considered by CP Engineers in the design of the strucmres. CP second concern was in section 5 of the restrictive covenant. CP requested that the subdivided lot be allowed to stand alone as they have an agreement to sell the lot back to Intrawest up to the year 2002. Cont'd .../2 DEC 0 9 1992 The third concern of CP's was the clean-up date of 1997. CP felt that a date could not be established because the time reouired for fuB remediation of the site cannot be determined. CP indicated that they are committed to undertaking the remediation pian, approved-in-principle by the Ministry of Environment and since the covenant is tied in with the remediation plan there should be no need to establish a completion date. CP said that they do not want to remediate the soil to a level for development as they intend the property to be part of their rail yard. CP said that should they plan to develop the property in the future they mould resubmit a remediation plan. The delegations from Intrawest and CP were dismissed from the meeting. Committee decided that section I of the agreement should have a clause which permits building on the property subject to approval by the City building inspector. Committee also asked that the covenant r'estrict the sale of the property uutE the year 2002 when Intrawest's option to purchase the land from CP expires. Furthermore, if Intrawest does not undertake their option with CP by 2002, then CP must consolidate their parcel with the adjacent raiilyard parcels. QXggJH 1993 ENVIRONltdHNTAL ACIIIEVEMBNT AWARDS Committee received a memo from the Project Engineer dated December 8, 1992 regarding the 1993 Environmental Achievement Awards. Corrtmittee agreed with the recommendation to resubmit the nominination after consulting with Mr. Al Grist. EKEld JE UNDERGROUND STORAGE TANK REGULATORY PROGRAM Committee received a memo from the City Administrator dated November 27, 1992 regarding the underground storage tank regulatory program. Committee requested that this item be deferred until they have more time to study the material snd consult with other departments. 11 ErfvI V: CFC Recoverv Con~ittee considered a memo dated December 8, 1992 on the GVRD's proposal to recover CFC."s from refrigerators at selected depots in the district. Committee agreed with the recommendation to provide a CFC recovery depot at the New Works Yard site on 1675 Broadway. Committee received a letter from the District of PoweB River regarding the Capital Region Referendum on Liquid Waste Management. Committee felt that the concerns of Powell River would be better dealt with at the UBChd level.
